The Finnframe Portal is a mobile phone application provided by Metsä Wood UK Ltd (business ID: 3071064, hereinafter “Service Provider”), which is an educational service intended to support contractors and site managers when installing the Metsä Wood Finnframe flooring system (hereinafter “Service”). Use of the Service requires that the user (hereinafter ”User”) downloads the Finnframe Portal and agrees to comply with these terms of use.
In addition to what is stated in these terms of use, the User undertakes to comply with any instructions issued separately by the Service Provider or instructions related to the use of the Service that appear in connection with the Service issued by the Service Provider or its contractual partner. The current terms of use are available in connection with the Service.
The Finnframe Portal allows the User, among other things, to: see static drawings of design details and animated sequences demonstrating the correct installation procedure of the Metsä Wood Finnframe flooring system as well as calculate the service hole with a calculator tool. The User agrees with and undertakes to comply with the following when using the Service:
The User receives and uses the Service at its own risk and is responsible for obtaining, maintaining and properly protecting the equipment, connections and software necessary to use the Service.
All rights in the Service, including copyrights, belong to the Service Provider or its contractual partners. The User may not use the Service in violation of the copyright or other rights of the Service Provider or a third party.
The Service Provider does not collect personal data from the User in the Service.
Use of the Service is free of charge for all Users.
The Service is provided “as is”. The Service Provider does not provide technical support for the content of the Service nor any direct or indirect guarantees regarding the operation or features of the Service and does not guarantee that the Service will operate without interruption and / or error-free.
The Service Provider is not liable for any special, consequential, incidental, punitive or indirect damages, including but not limited to loss of profit or revenues, loss of production, loss of contract, loss of increase expense of use of the Service, damage caused by the Service, downtime costs or other increased expense of operation, or claims of User’s customers or other third parties. Nothing in this clause shall apply so as to exclude or limit any liability of the Service Provider: (i) arising from any deliberate breach or willful misconduct on the part of the Service Provider or (ii) where and to the extent that the exclusion or limitation of the Service Provider's liability is prohibited by applicable law.
Damages must be claimed within one year from when the User noticed or should have noticed the damage.

These terms of use shall take effect once the User has accepted them electronically. The agreement is valid until further notice.
The Service Provider may terminate the agreement and terminate the Service for convenience at any time with one (1) months´ notice of termination to the User. Furthermore, the Service Provider reserves the unilateral right to suspend or terminate the User's access to the Service or any part thereof with immediate effect if the User violates these terms of use in any way.
The User may terminate the use of the Service by deleting the Finnframe Portal.
Termination shall not affect any terms intended to survive the termination.
The Service is in principle available twenty-four (24) hours a day. However, the Service Provider has the right to temporarily disable the Service or any part thereof due to maintenance, installation, modification work, public order and safety, excessive system load or any other similar reason. The Service Provider has the right to add, change and delete parts of the Service and to terminate the maintenance of the Service in part or in full.
The Service Provider is entitled to change the content, operation and these terms of use of the Service in order to develop the Service and for other necessary reasons. The changes take effect when the Service Provider notifies about it separately in the Service.
The Service Provider has the right to change the terms of use due to changes in legislation, exchange rates, taxes and other official orders, as well as unforeseeable circumstances beyond the Service Provider's control. Such amendments shall take effect immediately upon their entry into force.
The parties shall be released from their obligations under the agreement for the period and to the extent that the non-performance of the contractual obligations is due to events outside the parties control (force majeure). Exemption shall be deemed to be an unusual and relevant event which prevents the performance of the agreement and which occurred after the conclusion of the agreement, which is independent of the parties and the effects of which cannot reasonably be avoided or overcome.
The Service and these terms of use shall be construed, governed and interpreted in accordance with the laws of England and Wales, excluding its conflict of laws provisions. Any disputes or claim concerning the use of the Service and these terms of use will ultimately be resolved by the courts of England and Wales.
